Introduction

Your use of the website ceway.co.uk ("the Site") and the documents, files and other information available through it is subject to the following terms and conditions, as amended by us from time to time.

Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and, you agree to abide by them. If you do not agree to these terms of use please refrain from using our site.

Simplify Moving Limited and its Group of companies (also referred to as ‘Simplify’ "we" or "us") own or is the licensee of all intellectual property rights (including copyright and database rights) in and to the Site. We retain copyright in the documents prepared by us – if copyright is reserved by a third party it will be shown on the document. You may reproduce such materials for your personal use only and you may copy and distribute materials from the Site to others provided that you do so without charge, that you do not alter the materials in any way and that you acknowledge the Site as the source of the materials. Save as expressly permitted above, all use and reproduction of any material on this Site or any incorporation of the same into any other material, in whatever media or format, is strictly prohibited.

You may only access the Site for lawful purposes. You may not attempt to upload, delete, alter, or otherwise make any changes to the content of appearance of the Site of the software code contained in or relating to the Site. You may also not knowingly misuse the Site by introducing viruses or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any service, computer, or database on the Site. By breaching this provision, you may commit a crime under the Computer Misuse Act 1990, and we will report any such breach to the relevant law enforcement authorities.

Any materials on our Site are for information purposes only and are not intended to amount to any legal or other advice. Any advice you require about any specific issues should be sought from us on an individual basis. To the fullest extent permitted by law, we disclaim all liability and responsibility for any reliance on the materials on our Site.

We exclude to the fullest extent permitted by law all liability (save in respect of death or personal injury caused by negligence and of fraud) for any loss damage harm or costs suffered or incurred by any person or entity arising from or in connection with the use of the Site.

Any submission of any data or information to us via the Site or any other contact made via the Site should not be construed as creating a Licensed Conveyancer/client relationship between you and us unless expressly stated by us.

When you visit the Site, we may collect information about you. The information we collect is processed in accordance with our Privacy Policy. The relevant law firm is the data controller of the information in relation to that transaction and information on how they process data is contained in their respective Privacy Notice.

Security

Through the Site we provide a variety of services to clients and third parties which can only be accessed with a username and password. Use of these services is restricted to authorised persons only. If you believe you have been granted access to any document or file by mistake, please contact us by email or telephone immediately. Please also contact us if you have been provided with permission to access the services but are experiencing any problems.

Through eWay you can access information about your transactions with the relevant law firms, provide documents to the law firm and use other functionality that we make available from time to time.

We will provide or ask you to set security details for access to eWay. These could include a password, security code etc. We may change these requirements at any time.

If your transaction involves more than one person, each person named on the transaction can register for eWay. Each person will have separate details to access and use the service.

You must not disclose your username or password to any other person; if you believe someone other than you have acquired your log-on details please contact us.

You must not obtain or attempt to obtain unauthorised access to an area of the Site other than that which has been identified as being available to you through the usernames and passwords provided to you, or encourage, permit, or assist any other person to do so.

Access to eWay

We may make changes to the way that the services are accessed at any time. We will tell you about such changes by either placing a message on our website, via your mobile device, or by text, email or by post.

You are responsible for maintaining your computer or mobile device, for ensuing that it is compatible with the services and for downloading the latest version of the app.

Occasionally, we may need to carry out maintenance that may limit the availability of the services.

We shall use reasonable endeavours to keep the services free from viruses and corrupt files but cannot guarantee this. You should ensure that you have appropriate anti-virus software installed on any computer or mobile devices that you use to access the services. We shall not be liable for any loss or damage you suffer if your device is infected by a virus or corrupt file unless such loss or damage is the direct result of our negligence or deliberate default.

Changes to these conditions

We reserve the right to amend these terms and conditions from time to time and any amendments will take effect upon posting to the Site.

General

This agreement is personal to you, and you cannot transfer your rights or obligations to anyone else. We may transfer our rights and obligations at any time.

If any term of this agreement is found to be unenforceable, this will not affect the validity of any others.

All the information we give you and all communications from us will be in English. We will only accept communications and instructions from you in English.

The site and these terms and conditions shall be governed in all respects by English Law and is subject to the exclusive jurisdiction of the English Courts.
